1. Introduction

1.1. These Terms of Service (“Terms”) govern your access to and use of SpicyTalks, a Telegram bot for engaging in AI-driven roleplay conversations and generating AI-powered images (the “Service”).

1.2. SpicyTalks operates as a Telegram bot providing a web UI through Telegram’s web apps functionality. By using our Service, you also agree to comply with Telegram’s Terms of Service and Privacy Policy.

1.3. SpicyTalks utilizes third-party AI APIs to generate AI text and image content. By using the Service, you acknowledge that the AI-generated content is provided through these third-party providers.

1.4. By accessing or using the Service, you engage with our Service and accept these Terms, including any additional rules, provisions, and policies accessible via links provided within the Service. If you disagree with any part of these Terms, you may not use the Service.

1.5. These Terms apply to all users of the Service. Any new features or tools added to the Service shall also be subject to these Terms. It is your responsibility to review the latest version of these Terms periodically. Continued use of the Service after changes are published constitutes acceptance of those changes.

2. Eligibility and Access

2.1. You must be at least 18 years old to use the Service. By using SpicyTalks, you represent and warrant that you meet this age requirement.

2.2. We reserve the right to refuse access to the Service to anyone for any reason at any time.

2.3. You are responsible for any content you create or generate through the Service and agree to use the Service only for lawful purposes in accordance with these Terms.

2.4. Violation of any provision herein may result in immediate termination of your access to the Service.

3. User Content and Conduct

3.1. The Service allows you to engage in roleplay conversations with AI characters and generate AI-powered images. You are solely responsible for the content you create, request, or generate using the Service.

3.2. You agree not to use the Service to:

1. Create, request, or distribute any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
2. Unauthorized person impersonation.
3. Child exploitation or child pornography.
4. Non-consensual intimate imagery.
5. Content that promotes or facilitates human trafficking or prostitution.
6. Explicit violence or gore.
7. Any other content that violates local, national, or international laws.
8. Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
9. Violate any applicable laws or regulations.
10. Infringe upon or violate any intellectual property rights.

3.3. Any content that violates these rules may result in immediate suspension of your access to the Service and, where applicable, may be reported to the appropriate authorities.

4. Zero-Tolerance Policy for Illegal Content

4.1. SpicyTalks maintains a strict zero-tolerance policy regarding any illegal content or usage. This includes, but is not limited to:

1. Unauthorized person impersonation.
2. Child exploitation or child pornography.
3. Non-consensual intimate imagery.
4. Content that promotes or facilitates human trafficking or prostitution.
5. Explicit violence or gore.
6. Any other content that violates local, national, or international laws.

4.2. Any violation of this policy will result in immediate termination of access to the Service without prior notice.

4.3. We reserve the right to report any illegal activities or content to relevant law enforcement authorities immediately upon discovery.

4.4. Users are required to report any illegal content encountered on the Service by contacting our support via @HotTalksSupport.

5. Intellectual Property Rights

5.1. The Service and its original content (excluding user-generated content) are the exclusive property of SpicyTalks and its licensors. All rights, titles, and interests (whether registered or unregistered) in any part of the Service are reserved.

5.2. You retain any copyright you may have in the content you create using the Service. However, by using the Service, you grant SpicyTalks a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with providing the Service.

5.3. You acknowledge that AI-generated content may be based on or similar to existing copyrighted works. SpicyTalks does not claim ownership of such underlying works and cannot guarantee that the use of AI-generated content will not infringe upon third-party rights.

6. Payments and Refunds

6.1. SpicyTalks offers paid features processed through PayPal, Paddle, and Telegram Stars.

6.2. Payments are handled by third-party providers, and we do not store or directly handle your payment information.

6.3. Refund Policy:

1. Refund requests for payments made for access to paid features must be submitted within 24 hours from the time of purchase.
2. Refunds will be processed only for valid claims where technical issues have prevented proper access to the paid features.

7. Disclaimer of Warranties

7.1. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. SpicyTalks makes no warranties, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

7.2. SpicyTalks does not warrant that the Service will be error-free, uninterrupted, or free from viruses or other harmful components.

7.3. We do not guarantee the accuracy, reliability, or suitability of any AI-generated content produced by the Service.

8. Limitation of Liability

8.1. In no event shall SpicyTalks, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of, or inability to access or use, the Service;
2. Any conduct or content of any third party on the Service;
3. Any content obtained from the Service; and
4. Unauthorized access, use, or alteration of your transmissions or content.

8.2. To the extent permitted by law, our total liability shall not exceed the amount paid by you for the use of the Service.

9. Changes to the Service and Pricing

9.1. We reserve the right to change our prices at any time without prior notice.

9.2. We also reserve the right to modify or terminate the Service (or any part thereof) without prior notice.

9.3. We shall not be liable for any modifications, price changes, service suspension, or termination.

10. Changes to Terms

10.1. We reserve the right to modify or replace these Terms at any time. Any changes will be effective upon publication on the Service.

10.2. Your continued use of the Service after the publication of any changes constitutes your acceptance of the new Terms.
